A class action settlement has been reached in Kennedy, et al. v. EFS Advisors, LLC and Educators Benefit Consultants, LLC d/b/a Aviben over a data security incident on the defendants' computer network, detected by the defendants on or about February 22, 2024. The defendants deny wrongdoing and the Court has not decided who is right. The settlement establishes an $850,000 fund to pay valid claims for documented out-of-pocket losses and credit monitoring. Claim Forms must be submitted no later than October 22, 2026; the deadline to exclude yourself or object to the settlement is October 7, 2026, and the Final Approval Hearing is set for November 6, 2026.
