🌱 Limetree Bay Refinery Release Incidents Settlement

The lawsuits alleged that release incidents at the Limetree Bay Refinery from February to May 2021 caused property damage, nuisance, and economic and health harm to people in the surrounding area of St. Croix, U.S. Virgin Islands.

People who owned or rented property in the Affected Geographic Area on or after February 3, 2021, or who resided in, worked in, owned or operated a business in, or were present in the Affected Geographic Area between February 3, 2021 and May 26, 2021.

Pro rata share of a $59,795,000 settlement fund, allocated by a point system covering property damage, nuisance, trespass, economic losses, cistern-related physical impact, physical and emotional health manifestations, and unreimbursed out-of-pocket expenses

Court-approved class action settlements totaling $59,795,000 have been reached with defendants ArcLight, Freepoint, EIG, LBV, LBE and additional contractor defendants over alleged release incidents at the Limetree Bay Refinery in St. Croix, U.S. Virgin Islands, between February and May 2021. The settling defendants deny any violation of law and litigation continues against the remaining defendants. Payments to eligible class members are calculated on a pro rata point system covering property damage, nuisance, trespass, economic losses, cistern-related physical impact, physical and emotional health manifestations, and unreimbursed out-of-pocket expenses. The court-authorized notice was published September 11, 2026 by plaintiff firms Miller Thibodeaux Dysart Veith & Paschal, Burns Charest LLP and Berger Montague PC, directing class members to the official settlement website for the Claim Form. The claim deadline is November 3, 2026.
