The case, In re Mt. Baker Imaging, LLC Data Security Litigation (Superior Court of Washington for Whatcom County, No. 25-2-00463-37), stems from a ransomware attack that struck the two affiliated Bellingham-area radiology providers over roughly five days in late January 2025, during which attackers accessed and exfiltrated patient PII and PHI. The defendants deny any wrongdoing or liability but agreed to a $3,300,000 non-reversionary settlement fund to avoid the risk and expense of continued litigation. Judge Evan Jones granted preliminary approval on April 21, 2026, with a final approval hearing set for August 21, 2026. Class members can recover documented out-of-pocket losses up to $5,000, a pro rata share of the cash fund, and two years of medical identity-theft monitoring through CyEx, but only if they submit a valid claim by the August 19, 2026 deadline.
