Background
Perry v. Alatrade Foods, Inc., No. 4:25-cv-00521-CLM, is pending in the U.S. District Court for the Northern District of Alabama, Middle Division. The plaintiff alleges Alatrade laid off workers at its Phenix City, Alabama processing facility without the 60 days' notice the Worker Adjustment and Retraining Notification (WARN) Act requires; Alatrade denies the allegations and raises defenses including the unforeseeable-business-circumstance and faltering-company defenses. Alatrade agreed to a non-reversionary $500,000 settlement fund, from which class members receive a pro rata share of the net fund after fees and costs. The official class notice states class members must submit a valid claim form, by mail or online, postmarked or submitted no later than September 16, 2026, with a fairness hearing set for October 2, 2026.
