Background
A proposed class action settlement has been reached in Carrero, et al. v. AMN Healthcare, Inc. et al., Case No. 37-2023-00052448-CU-NP-CTL, pending in San Diego County Superior Court, California. Plaintiffs Bertha Carrero and Angelina Lara De Carrero allege that AMN monitored and/or recorded interpreted conversations between patients and their medical providers without notice or consent, in violation of the California Invasion of Privacy Act. AMN agreed to a $4.5 million settlement fund and has issued internal instructions to cease monitoring and/or recording interpretation sessions in California unless further procedures are put in place. The claim deadline, opt-out deadline, and objection deadline are all October 27, 2026, and the final approval hearing is scheduled for December 18, 2026.
